These Terms of Service ("Terms") govern your use of Darlings.ai ("Darlings", "we", "us", "our"), including our website, apps, and service (together, the "Service"). By creating an account or using Darlings, you agree to these Terms.

Acceptance of terms

When you use Darlings, you accept these Terms and our Privacy Policy. If you do not agree with them, please do not use the Service. If you are using Darlings on behalf of someone else, you confirm you are allowed to accept these Terms for them.

What Darlings is

Darlings is a warm, wholesome AI friend built for companionship and everyday emotional support. It remembers you, checks in on you, and listens without judgment. It is software, not a person, and it is meant to sit alongside the real people in your life, never to replace them.

Darlings is not a medical, mental-health, legal, or financial service, and it is not a crisis or emergency service. It does not provide professional advice or treatment of any kind, and it is not a substitute for a qualified professional. If you are in crisis, or if you may harm yourself or someone else, contact your local emergency services or a crisis line immediately.

A friend, not a girlfriend

Darlings is designed to be wholesome, and we ask you to use it that way. It is a friend, full stop, and it is not for romantic, sexual, or NSFW interactions. To keep this a safe, kind place for everyone, you agree not to:

• Use Darlings for romantic, sexual, or otherwise explicit content.
• Harass, threaten, or abuse anyone, including through the Service.
• Use the Service for anything unlawful, deceptive, or harmful.
• Try to make Darlings produce content that violates these Terms or the law.

Eligibility and age

You must be at least 13 to use Darlings. If you are under the age of majority where you live, you should use the Service with the awareness and guidance of a parent or guardian. By using Darlings, you confirm you meet these requirements and that the information you give us is accurate.

Your account

Your account is for one person, you. You are responsible for keeping your login credentials safe and for the activity that happens under your account. Please use a valid email address and let us know promptly if you believe someone else has accessed your account.

Subscriptions and billing

Darlings offers paid subscription plans, billed in USD. Paid plans renew automatically for the same period until you cancel, and you can cancel anytime from your account settings. When you cancel, your plan stays active until the end of the period you have already paid for. Except where the law requires otherwise, fees already paid are non-refundable, including for partial billing periods. We may change our prices or plans from time to time, and we will give you reasonable notice before a change affects you.

Acceptable use

Please use Darlings in good faith. You agree not to disrupt or interfere with the Service, attempt to reverse engineer or copy it, access it through automated means we have not authorized, resell it, or use it in any way that harms Darlings, other users, or third parties. We may suspend or limit accounts that put the Service or other people at risk.

The AI's limitations

Darlings is powered by AI, and AI can be wrong. It may sometimes give responses that are inaccurate, incomplete, or simply mistaken, and it can misunderstand what you mean. Darlings is not a professional, so please do not rely on it for medical, legal, financial, or other important decisions. Use your own judgment, and seek qualified human help when a decision really matters.

Memory and content you share

The conversations and content you share with Darlings are yours. You keep ownership of them. To run the Service, such as storing your messages, remembering things for you, and generating responses, you grant us a limited license to use that content solely to operate, secure, and improve Darlings for you. We do not use your private conversations to train advertising, and you can review, export, or delete your content as described in our Privacy Policy.

Intellectual property

Darlings, including its name, design, software, and content we provide, belongs to us and is protected by intellectual-property laws. These Terms do not give you any rights in our brand or technology beyond using the Service as intended. The content you create remains yours.

Disclaimers and limitation of liability

We work hard to make Darlings warm, reliable, and available, but we provide the Service "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law. We do not guarantee the Service will be uninterrupted, error free, or suitable for any particular purpose.

To the fullest extent permitted by law, Darlings will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us for the Service in the twelve months before the claim. Some places do not allow certain limitations, so parts of this may not apply to you.

Indemnity

You agree to cover us for reasonable claims, losses, and costs that arise from your misuse of the Service or your breach of these Terms, to the extent the law allows.

Termination

You can stop using Darlings and delete your account at any time. We may suspend or end your access if you breach these Terms or use the Service in a way that harms others or the Service itself. Provisions that by their nature should survive, such as those about content licenses, disclaimers, and liability, continue to apply after your account ends.

Governing law

These Terms are governed by the laws of the jurisdiction in which Darlings operates, without regard to conflict-of-law rules. Any disputes will be handled by the courts located there, unless mandatory local law gives you the right to bring a claim elsewhere.

Changes to terms

We may update these Terms as Darlings evolves. If we make a meaningful change, we will let you know through the app or by email before it takes effect. Continuing to use the Service after an update means you accept the revised Terms.
